Examining the Various Types of Sexual Offenses

The Texas penal code differentiates between several types and degrees of sexual offenses. If you’ve been accused of a sex crime, you need a criminal defense lawyer in Dallas who can help you understand the allegations against you. The following are brief explanations of sex crimes under Texas law.
Sexual Assault
Sexual assault involves penetration of the mouth, anus, or sexual organ of another person without consent, through the use of coercion, or if the person is unconscious or otherwise unable to consent. Penetration of a minor also falls into this category, even if the minor has consented. For a crime to be classified as aggravated sexual assault, it must involve the use of physical force, a weapon, forced ingestion of drugs, or a victim who is under the age of fourteen, disabled, or over the ages of 65.
Indecency with a Child
Engaging in any sexual activity with a minor qualifies as indecency with a child, as does exposure of the genitals for purposes of sexual gratification with a minor. However, if the perpetrator was less than three years older than the victim and the contact did not involve force or duress, it is not defined as indecency with a child.
Online Solicitation of a Minor
This sex crime involves soliciting a minor for sexual activity over the Internet or through text messages, or communicating explicitly with a child via electronic means.
Possession or Promotion of Child Pornography
Possession of any depiction of a minor involved in real or simulated sexual activity is classified as possession of child pornography. Possession of said materials with intent to distribute is an offense that carries a harsher sentencing potential.
